TERMS AND CONDITIONS - CONVERT APP

These Convert Terms of Use (“Terms of Use”) govern the access, use, and operation of CONVERT's digital platforms, including the website (“Site”) and the Convert App for mobile devices (“Platforms”). These Terms of Use represent a valid contract between the User and CONVERT Services, applicable to the entire CONVERT Platforms environment.

The Platforms are provided and managed by CONVERT App, a limited liability company, headquartered in the Municipality of São Paulo, State of São Paulo (“CONVERT” or “Company”).

For the purposes of these Terms of Use, “User” or “You” means the individual who uses or accesses the Platforms or its content, whether the user or the establishment.

THE USE OF CONVERT PLATFORMS IS SUBJECT TO ACCEPTANCE OF THESE TERMS OF USE AND THE PRIVACY POLICY.

These Terms of Use were last updated on 09/30/2024.

These Terms of Use apply to all Platforms. Unless otherwise expressly stated in these Terms of Use, any new features implemented on the Platforms will be subject to these Terms.

1. Terms of Use

The use of the Platforms will necessarily depend on an Internet connection, with the User being solely responsible for obtaining this connection. Charges and fees may apply if You access or use the Platforms through your mobile data network package. You are responsible for acquiring and updating the equipment and devices necessary to access and use the platforms, which are subject to updates.

Convert does not guarantee that the platforms or any part of them will work properly on any particular equipment or device. Convert is not responsible for the unavailability of the platforms due to errors and malfunctions of public or private systems used to access the platforms.

You must provide personal data to register on the Platforms. Your personal data must be true, accurate, and complete to meet the authentication requirements of the Platforms. If any of your personal data changes, You must provide the updated information.

2. Registration

To access the Platforms and available Services, You must register and maintain a personal and non-transferable User account for the Services (“User Account”) or a Provider account (“Establishment Account”).

You can register your User Account or Establishment Account by providing an email address and setting a personal and non-transferable password. It will be necessary to inform your Instagram profile so we can validate ownership by sending a code via direct message to @convert.app.

3. User Responsibility

By using the Platforms, You agree to be responsible for maintaining the confidentiality of your account and password and for restricting access to the device used to access the Platforms, being responsible for all activities that occur under your User Account.

4. Privacy and Data Protection

ACCESS TO AND USE OF THE PLATFORMS SUBJECT THE USER TO THE PROCESSING OF CERTAIN INFORMATION, INCLUDING PERSONAL DATA. CONVERT IS TRANSPARENT ABOUT ITS DATA PROCESSING AND PROTECTION PRACTICES.

6. General Provisions

a. Applicable Law and Jurisdiction. These Terms of Use and the relationship between the User and CONVERT will be governed by the laws of the Federative Republic of Brazil. The forum of the Capital of the State of São Paulo is elected as the only competent court to resolve any disputes and/or demands involving the parties concerning the use and access to the Platforms.

b. Electronic Communications. By using the Platforms, by sending us emails or other types of communication from any electronic device, you will be communicating with us electronically.

c. User Account Deletion. If You wish to delete your User Account and personal data stored by CONVERT, You must request deletion directly from CONVERT via the app.

d. Changes to these Terms of Use. These Terms of Use may be changed periodically.

e. Platform Usage Limitations. CONVERT reserves the right to monitor and evaluate user booking patterns. If CONVERT determines, at its sole discretion, that a user is exploiting the platform by making an excessive number of bookings within a short period of time, CONVERT may implement usage restrictions or limitations for that specific user. These limitations may include, but are not limited to, temporary suspension of booking privileges or account restrictions.
